This Privacy Policy describes the information that we, Realtime Worlds Inc, a US corporation at 5480 Valmont Rd. Suite 350, Boulder, CO 80301 (“RTW,” “we,” “us” or “our”) collect from you through the website www.apb.com and www.realtimeworlds.com (collectively, the “Sites”) or any other linked pages, features, content, or applications offered from time to time by us in connection therewith (collectively with the Sites, the “Service”). Please note that this Privacy Policy applies solely to our online information-gathering and use practices, and does not apply to any of our offline practices. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

By visiting any of the Sites or using the Service, you signify your assent to this Privacy Policy. If you do not agree to this Privacy Policy, please do not use any the Sites or the Service.

1 Information We Collect


1.1 Personal Information

When you use the Sites or the Service, you may be asked to provide certain personal information which can be used to identify you or contact you, such as your name, country, gender, email address (“personal information”).

Personal information is typically collected in any of the following circumstances: (i) registration for online game participation or subscription services, (ii) surveys or newsletters.

You can access at least some parts of the Sites without providing personal information, however, you will not be able to fully utilize the Service or certain other features that require registration, or receive from us materials such as newsletters, unless such information is provided.

1.2 Other Information

We may also ask you to provide or collect other information that cannot be used to identify you, such as date or year of birth, age, gender, preferences, and geographic location. We also collect, receive and store certain types of information whenever you interact with the Sites or the Service, including without limitation computer capabilities, IP addresses, browser type and language, access times and referring web site addresses, and information about your visit and game play, such as the pages you view, the links you click and session data. To do this, we may use cookies and other technology (see Section 2.3 below for more detail about the use of such technologies) and we may acquire such non-personal information from third party online tracking service providers. We may combine non-personal information with personal information. Such information by be disclosed by us to third parties in a non-personally identifiable manner (e.g. in aggregate form).

2 Use of Information


2.1 Personal Information

  1. General Uses. The personal information you provide will allow us to complete your registration; fulfill your service request; alert you of new products or services, features, or enhancements; and/or notify you of contests, promotions, or special events and offers.
  2. Disclosure to Third Parties.
    1. Agents. We employ third party vendors to collect personal information on our behalf in connection with the Sites and the Service, and your personal information may be disclosed to third parties that we have engaged to perform services for us in connection with the Service.
    2. Disclosure for Enforcement Purposes. Your personal information may be disclosed to law enforcement or other appropriate third parties in connection with criminal investigations, investigation of fraud, infringement of intellectual property rights, or other suspected illegal activities, or as otherwise may be required by applicable law, or as we deem necessary in our sole discretion in order to protect our legal and business interests.

      We reserve the right to disclose your personal information as required when we have reason to believe that disclosing such information is necessary to identify, contact, or bring legal action against you to enforce or apply our conditions of use and other agreements, or if you are causing injury to or interference with (intentionally or unintentionally) our rights or property, other users of the Service, or anyone else.

    3. Business Transfers. We reserve the right to transfer any and all information that you provide, or that we otherwise collect in connection with the Sites or the Service, in connection with a sale or transfer of assets of any portion of our business, or in the unlikely event that we go out of business or enters bankruptcy. You acknowledge that such transfers may occur, and that any acquirer of RTW may continue to use your personal information as set forth in this policy.
    4. Affiliated Businesses We Do Not Control. We are affiliated with a variety of businesses and work closely with them. In certain situations, these businesses sell items to you through the Sites. In other situations, we provide services or sell products jointly with affiliated businesses. You can easily recognize when an affiliated business is associated with your transaction, and we will share your personal information that is related to such transactions with that affiliated business, if you have agreed to be solicited by marketing partners during the registration process.
    5. User profiles. In the event any of the Sites or the Service allows you to submit profile information (including, without limitation, users’ name, email address, and other information you enter) (“User Submissions”), such User Submissions may be displayed to other users to facilitate user interaction within the Sites. Email addresses may be used to add new user submissions to user profiles and to communicate through user submissions. Users’ email addresses will not be directly revealed to other users by us except when the user is “connected” to another user via a shared group membership, or an invitation, or if the user has chosen to include their email address in their user profile.

    Except as set forth above, you will be notified when your personal information may be shared by us with third parties, and will be able to prevent such sharing.

  3. Internal Uses. We may use your personal information for internal marketing, profiling, or demographic purposes, so we can adapt our products and services to better suit your needs.

2.2 Other Information

We may use any information that is not personal information to generate aggregate statistics about our user community and may provide such information to advertisers and/or our partners. In addition, we may use such information for security, system integrity (the prevention of hacking, cheats, etc.) or enforcement purposes.

2.3 Cookies

We use cookies and other technologies to personalize your experience and monitor Site and Service usage. Cookies are small files downloaded to your computer to track movements within web sites. We may link cookie information to personal information.

Most internet browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. Please note, however, that if you block cookies, some portions of the Sites or the Service may not function properly.

Other technologies we may use from time to time include clear GIFs. Clear GIFs are small graphic images placed on a web page, web-based document, or in an e-mail message and that are invisible to the user because they are very small (often just 1-by-1 pixel) and the same color as the background of the web page, document or e-mail message. We do not use clear GIFs to collect personal information about you. However, we may use clear GIFs to capture statistical usage information for our web pages, features or other elements on a web page. We may correlate this information to a user to personalize user experience and for statistical analysis of user experiences on our web pages.

3 General


3.1 Security

We adopt commercially reasonable security measures consistent with industry practice to assist in protecting against the loss, misuse, and alteration of personal information which is under our control, but no security system can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of our servers, the means by which information is transmitted between your computer and our servers, or any information provided to us or to any third party through or in connection with the Sites or the Service. You provide all such information entirely at your own risk.

3.2 Revisions to Privacy Policy

We reserve the right to update and revise this Privacy Policy at any time. Please check the Privacy Policy each time you use any of the Sites or the Service to ensure you are aware of any changes in our practices. You can determine if this Privacy Policy has been revised since your last visit by referring to the “Last Updated” date at the top of this page. All changes to the Privacy Policy will be effective when posted, and your continued use of any Site or the Service after the posting will constitute your acceptance of, and agreement to be bound by, those changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used.

3.3 Minors

Persons under age 13 are not permitted to use this Service. Except as may be required by law, we will not knowingly collect, maintain, or disclose any personal information from persons under the age of 13.

If you are between the ages of 13 and 18, please have your parent or legal guardian read this Privacy Policy, and get his or her permission before you provide any personal information.

3.4 Links to Other Sites

Our Sites or the Service may contain links to other websites. This Privacy Policy applies solely to the information which is collected in or through the Sites or the Service. We are not responsible for the privacy practices or content of such other websites, and any link does not constitute any endorsement on our part of any such other websites.

Additionally, there may be unauthorized third party web sites that may be providing links from their sites to our Sites without our knowledge or control. We are not responsible for the content of any third party web sites, expressly disclaim any statements or assertions made on such web sites, and deny all liability associated with your use of, and the content on, such other sites or advertisements contained therein.

4 Location of Data Processing


Many of the computer systems on which your personal information is collected, stored and used are owned by third party vendors and are located in, Europe, the United States and elsewhere. Your personal information may be transferred to, used, processed or held by us on systems located in, the United States and in other countries, including countries outside the European Union. By using the Sites or the Service, you agree that we may undertake the foregoing and may also transfer your personal information outside the European Union in connection with the purposes stated in this Privacy Policy. Your personal data may be transferred to the United States (and/or other non-EU jurisdictions, as applicable).

5 Fraud Alert — Phishing and Pop-Ups


One of the latest kinds of Internet fraud is a form of online identity theft known as “phishing.” Phishing scam e-mail messages can be difficult to differentiate from a genuine e-mail message from us. Though phishing scams can differ, the paragraph immediately below briefly describes how a typical phishing scam might be carried out.

A phishing scam typically begins when you receive an e-mail message that appears to be from us, with a reasonable request — possibly to verify your personal information or account details. The e-mail message may state a consequence for not responding to such request, including, for instance, suspension or closure of your account. The e-mail message may ask you to respond directly to the message, but more likely you will be asked to clink on a link in the e-mail message — and when you click on the link, you are taken to a web site that asks you to provide your personal information. While this web site may look authentic, and may even contain links to our Sites, it is in fact a “spoof” site that is set up to steal your personal information.

If you receive such an e-mail message, do not respond, click on any link or otherwise provide any personal information or account details. While we may send you e-mail messages from time to time, we will never send you e-mail messages asking for your personal information or account details. If you suspect that you have received a “phishing” scam email, please forward it to our Privacy Policy Administrator at: webmaster@realtimeworlds.com for investigation and delete the e-mail message upon forwarding.

In addition to phishing, another kind of online identity theft occurs through the use of pop-up windows asking for personal information or account details. We do not use pop-ups on our Sites, and any pop-ups are not from us. You should not provide any information through any pop-ups.

6 Your Choices Regarding Your Personal Information


You have the following choices with respect to your personal information:

  • As stated previously, you can always opt not to disclose your personal information, even though it may be needed to take advantage of certain features on the Service.
  • You can add or update certain information on pages, such as those listed in the “Access” section above. When you update information, however, we often maintain a copy of the unrevised information in our records.
  • You may request deletion of your account by sending an e-mail to unsubscribe@apb.com. Please note that some information may remain in our records after deletion of your account.
  • If you do not wish to receive email or other mail from us, please indicate this preference during the registration process. Please note that if you do not want to receive legal notices from us, such as this Privacy Policy, those legal notices will still govern your use of the Sites, and you are responsible for reviewing such legal notices for changes.
